1. Acceptance of Terms
By downloading, installing, or using Ember ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Ember ("we," "us," or "our").
2. Description of Service
Ember is a mobile application for iOS that allows users to track their menstrual cycle, log symptoms, monitor mood and energy, and view predictions and insights about their cycle. The App stores all data locally on the user's device.
The App is available in two tiers:
- Free: Core tracking features including period and flow logging, smart predictions, 12 symptom trackers, mood and energy logging, calendar view, cycle ring dashboard, reminders, home screen widgets, and Apple Watch app.
- Premium: All free features plus 40+ symptom trackers, BBT temperature charting, cervical mucus tracking, fertility window and TTC mode, health insights and correlations, data export (PDF/CSV), advanced charts and analytics, phase-based education and tips, and iCloud sync across devices.
3. Medical Disclaimer
Ember is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.
The predictions, insights, fertility windows, and other information provided by the App are estimates based on the data you enter and statistical models. They should not be relied upon for:
- Medical diagnosis or treatment decisions
- Contraception or family planning as a sole method
- Detecting or monitoring medical conditions
Always consult a qualified healthcare professional for medical advice. If you have concerns about your menstrual health, reproductive health, or any symptoms you are experiencing, please consult a doctor.
4. User Responsibilities
You agree to:
- Use the App in accordance with these Terms and applicable laws
- Understand that data accuracy depends on the information you provide
- Take responsibility for backing up your data (via iCloud sync or data export) if data preservation is important to you
- Not reverse engineer, decompile, or disassemble the App
- Not use the App for any unlawful purpose
5. Data Ownership
You own all data you enter into Ember. Since all data is stored locally on your device, you have complete control over it. We do not claim any ownership or license over your health data. See our Privacy Policy for full details on how your data is (not) handled.
6. Premium Subscriptions and Purchases
6.1 Pricing
Premium is available through the following purchase options:
- Monthly: $4.99 per month
- Yearly: $29.99 per year
- Lifetime: $59.99 one-time purchase
Prices may vary by region and are displayed in your local currency in the App Store.
6.2 Billing
All purchases are processed by Apple through the App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
6.3 Free Trial
We may offer free trial periods for Premium subscriptions. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
6.4 Cancellation
You can cancel your subscription at any time through your Apple ID subscription settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until that date.
6.5 Refunds
Refund requests are handled by Apple in accordance with their refund policy. To request a refund, visit reportaproblem.apple.com.
7. Intellectual Property
The App, including its design, code, graphics, icons, and content (excluding user-generated data), is the intellectual property of Ember and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not warrant that the App will be uninterrupted, error-free, or completely secure.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
- We are not liable for any data loss resulting from device failure, app deletion, or any other cause, as data is stored locally on your device.
9. Indemnification
You agree to indemnify and hold harmless Ember and its developers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
10. Modifications to the App and Terms
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time. We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. Material changes will be communicated through an in-app notification or update notes.
11. Termination
You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or restrict access to the App if you violate these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ember regarding the use of the App.
